Lindsay Clancy Case: Her Lawyer Seeks to Dismiss Murder Charges

Lindsay Clancy's attorney has filed a new motion to dismiss the murder charges against her for the deaths of her children, arguing that the trial judge should have done more to investigate claims from jurors that a dissenting juror was not applying the law according to instructions. The motion, submitted on Monday in Plymouth Superior Court by attorneys Kevin Reddington and Martin Weinberg, states that a new trial would violate Clancy's rights against being tried twice for the same offense, as the allegations shared with the judge 'required sufficient judicial inquiry to determine if her right to an impartial jury was being violated.' Earlier this month, 11 of the 12 jurors were ready to exonerate Lindsay Clancy of criminal liability, with most believing the Massachusetts mother was under the influence of a rare condition called postpartum psychosis when she strangled her children in 2023. However, a single juror sided with prosecutors, who argued that Clancy knew what she was doing. The deadlock continued, and Judge William Sullivan declared a mistrial on September 4. So far, the only statement from the jury, released through their attorney, is that they 'had no doubt' Clancy should be found guilty of murder. Clancy's legal team had previously requested that Sullivan declare her not guilty. Among other motions filed in court over the past week, Reddington is asking for the preservation of jury questionnaires and other documents, including those from the juror who voted to convict her. 'I hope Judge Sullivan will authorize the termination of the case,' Reddington told reporters on Monday. 'It's a case that simply needs to be resolved.' When asked about the dissenting juror's statement, Reddington said he had no reaction, adding, 'We resolve that in the courtroom.' During the trial, neither side disputed that Clancy strangled her children, Cora, Dawson, and Callan, in the family home before attempting to take her own life. However, Reddington claimed she was a loving mother experiencing deep delusions and other mental health issues for which she was receiving treatment. Plymouth County District Attorney Tim Cruz has not yet indicated whether he plans to retry the case. Reddington noted that he has not spoken with him. 'Tim and I have known each other for a long time. I met him when he was a defense attorney, and I obviously know him as a prosecutor, and I'm sure Tim will reach out to me,' Reddington said. Reddington has expressed a desire for the next trial to proceed as quickly as possible. The next hearing is scheduled for September 29. Reddington also reacted to an interview on '60 Minutes' with Clancy's ex-husband, who spoke about their children, his ex-wife, and his own life. Patrick Clancy said he forgave Lindsay for the deaths of their three young children in his first televised interview since the jury was deadlocked in the trial over the children's deaths. He also discussed his grief, noting that he struggled with suicidal thoughts after the homicides and experienced a panic attack while testifying in Lindsay's trial when attorneys played for the jury his 911 call reporting the children's deaths.
